I would vote for State. According to the 4th amendment, it protects from unwanted search and seizure. However there are also exceptions, like vehicle searches. Even if the dog was not trained to detect pseudoephedrine the "totality of the circumstance" gave probable cause for the police to search his car. The police have a job as well, if they fail to do that job they get fired. The police are not responsible,and where only responding to the alerts of the drug detection dog. This is is enough probable cause for search of the inside of the vehicle. Vehicle searches are exceptions for a reason. If illegal drugs/contraband are suspected a search can be preformed warrant less, and without hurting anyone's rights. Therefore, the police had suspicion that there was illegal drugs/contraband because of the alert from the drug detection dog, which is probable cause to search the vehicle.
